1. Quotations and Acceptance

1.1 All quotations are issued by K2016151581 (Pty) Ltd trading as Airconworld (“Airconworld”).

1.2 Unless otherwise stated, quotations include a standard back-to-back installation. Additional materials, labour, or non-standard installation requirements will be quoted separately.

1.3 Quotations are valid for seven (7) days from the date of issue and may be subject to change due to supplier price increases. The Customer will be notified of any such changes as soon as reasonably possible.

1.4 Acceptance of a quotation is confirmed upon receipt of the required deposit as specified in the quotation.


2. Installation and Site Conditions

2.1 Installation dates are subject to availability and weather conditions. In the event of unsafe conditions (e.g. heavy rain), installations may be rescheduled.

2.2 Installations are carried out according to industry standards and manufacturer requirements. Any deviations requested by the Customer must be agreed to in writing and may affect warranties.

2.3 The Customer must ensure that:

  • The installation area is accessible and safe;
  • All valuable items are removed or protected;
  • A responsible person is present (if required) to approve installation placement.

2.4 Airconworld will take reasonable care to minimise dust and disruption but is not responsible for professional post-installation cleaning.

2.5 Airconworld shall not be liable for pre-existing structural, electrical, or latent defects discovered during installation.

2.6 If asbestos or hazardous materials are present, the Customer must disclose this in advance. Airconworld will not be liable for any asbestos-related risks or disturbances.


3. Risk, Ownership and Use

3.1 Ownership of all equipment remains with Airconworld until full payment has been received.

3.2 Risk in the equipment passes to the Customer upon delivery and installation.

3.3 The Customer agrees to use and maintain the equipment in accordance with manufacturer and Airconworld guidelines.


4. Payment Terms

4.1 Payment terms are as follows:

  • Supply and installation: 70% deposit upon acceptance, balance due upon completion.
  • Supply only: 100% payment upfront.

4.2 Final payment is due upon presentation of the invoice, unless otherwise agreed in writing.

4.3 Overdue accounts may be subject to:

  • A reasonable administration fee; and/or
  • Interest charged in accordance with applicable law.

(Note: excessive penalties removed to align with CPA fairness requirements)


5. Returns, Cancellations and Refunds

5.1 Cancellation of confirmed orders may be subject to a reasonable cancellation fee, taking into account costs already incurred.

5.2 Returns will only be considered if:

  • Goods are unused, unopened, and undamaged;
  • Returned within seven (7) working days (subject to CPA cooling-off where applicable).

5.3 Approved returns may be subject to a handling/restocking fee of up to 15%.

5.4 Refunds will only be processed after inspection and acceptance of returned goods.

5.5 Transport and courier costs for returns are for the Customer’s account unless otherwise agreed.


6. Warranties and Maintenance

6.1 Manufacturer warranties apply in accordance with their terms and conditions.

6.2 Any additional warranties offered by Airconworld must be explicitly stated on the quotation and invoice.

6.3 To maintain warranty validity, equipment must be serviced at recommended intervals.

6.4 Failure to service or unauthorised repairs may void applicable warranties.


7. Lifetime Warranty (If Applicable)

7.1 The lifetime warranty is offered solely by Airconworld and not the manufacturer.

7.2 The lifetime warranty applies only if clearly stated on the quotation and invoice.

7.3 Conditions of the lifetime warranty include:

  • Mandatory servicing every six (6) months;
  • Servicing and repairs conducted exclusively by Airconworld or its authorised agents.

7.4 Failure to comply with these conditions will result in termination of the lifetime warranty.

7.5 The lifetime warranty excludes damage caused by external factors, including but not limited to power surges, lightning, misuse, or negligence.

7.6 Under the lifetime warranty:

  • Repairs and parts are covered at no charge;
  • Replacement units may incur a standard installation fee.

8. Liability

8.1 Airconworld will exercise reasonable care and skill in providing services.

8.2 To the extent permitted by law, Airconworld shall not be liable for:

  • Indirect or consequential damages;
  • Losses arising from delays outside its control;
  • Damage caused by factors beyond its reasonable control (force majeure).

8.3 Nothing in these terms excludes or limits rights that the Customer may have under the Consumer Protection Act.

(Important: this clause keeps you compliant and avoids illegal “no liability” wording)


9. Acceptance of Work

9.1 Upon completion, the Customer or their representative may be required to sign an installation completion or acceptance document.

9.2 Signature will constitute confirmation that the installation has been inspected and is satisfactory, without limiting the Customer’s statutory rights.


10. General

10.1 These Terms and Conditions are governed by the laws of South Africa.

10.2 If any provision is found to be invalid or unenforceable, the remaining provisions will remain in effect.
